1. Overview. This website is operated by Avonte LLC, doing business as NEVER EVERY™ ("we," "us," "our"). By accessing or using neverevery.com and any related services (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

3. Products. We make every effort to display our products and their colors accurately; we cannot guarantee that your display will render them precisely. Products are subject to availability, and we reserve the right to limit quantities or discontinue any product at any time.

4. Product Imagery. Certain imagery may be digitally created or enhanced. Some product imaging may be synthesized from generative tools and digital rendering to depict product fit, color, design, construction and overall impression. It is always our intention that images depicted in all digital media fully represent our products as truly and accurately as possible.

5. Orders & pricing. All prices are in US dollars and are subject to change without notice. Your order is an offer to purchase; we reserve the right to accept, decline, or cancel any order, including for suspected error, fraud, or limits on quantities. You authorize us and our payment processor to charge your selected payment method upon order confirmation.

6. Intellectual property. NEVER EVERY™ and NEVER+EVERY™, the NEVER EVERY name and logos, and all related product names, designs, wordmarks, and slogans are trademarks of Avonte LLC. All rights reserved. All site content — including text, graphics, images, and product imagery — is the property of Avonte LLC or its licensors and is protected by applicable intellectual-property laws. Nothing on this site grants any license or right to use any Avonte LLC trademark or content without Avonte LLC's prior written permission.

7. Acceptable use. You agree not to use the Site for any unlawful purpose, to infringe our rights or those of others, or to interfere with the Site's operation or security.

8. Disclaimers. The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated.

9. Limitation of liability. To the fullest extent permitted by law, Avonte LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products. Where liability cannot be excluded, it is limited to the amount you paid for the order at issue.

10. Governing law. These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in New York.
